About this Course

The Negotiation and Conciliation course provides an in-depth understanding of two critical dispute resolution methods widely used in commercial and legal settings. This course covers the key stages of negotiation, from preparation and offers to settlement, while exploring advanced techniques such as BATNA (Best Alternative to a Negotiated Agreement), WATNA (Worst Alternative), and ZOPA (Zone of Possible Agreement). You will also learn the role of the conciliator as a neutral facilitator, helping parties reach a binding agreement. The course emphasises the importance of handling difficult parties, managing power imbalances, and building trust to ensure cooperation. Additionally, you’ll gain practical skills in drafting effective negotiation and conciliation clauses and understand the legal framework under the Arbitration and Conciliation Act, 1996. Real-world case studies and simulation exercises will further solidify your expertise in this vital field.
