About this Course

The Mediation and Conciliation course is designed to provide a holistic understanding of two essential methods of Alternative Dispute Resolution (ADR). Integrating theoretical foundations with practical training, this course equips professionals to navigate both mediation and conciliation processes confidently and ethically.

Participants will begin by exploring the legal landscape of mediation, including the Mediation Act, 2023, court-referred mediation, and international frameworks like the Singapore Convention. The course then delves into the core principles of mediation, covering neutrality, voluntariness, confidentiality, and informed decision-making.

Through an in-depth look at the mediation process, learners will understand each stage — from initial contact to drafting and enforcing settlement agreements. The course also emphasises communication techniques essential for managing emotions, building rapport, and breaking impasses.

The conciliation component introduces the role of the conciliator, negotiation strategies such as BATNA, WATNA, and ZOPA, and key differences between mediation and conciliation under the Arbitration and Conciliation Act, 1996. Real-life case studies and simulation exercises will provide hands-on experience in facilitating agreements and handling complex dynamics, including power imbalances and difficult parties.

By the end of this course, participants will have the legal knowledge, strategic mindset, and interpersonal skills to practice as effective mediators or conciliators in diverse dispute resolution contexts.
