<li>Grounds for Referral to Arbitration:</li>
</ol>

<li aria-level="2">Existence of Valid Arbitration Agreement: There exists a valid and binding arbitration agreement between the Applicant and the Respondent as per clause number [Clause Number] of the contract dated [Date].</li>
<li aria-level="2">Subject Matter of the Suit Covered by Arbitration Agreement: The subject matter of the suit filed by the Respondent/Plaintiff falls squarely within the scope of the arbitration agreement, as it directly arises out of the contract containing the arbitration clause.</li>
<li aria-level="2">Application Made Before First Statement on Substance: This application is being made before the Applicant/Defendant files its first statement on the substance of the dispute, as prescribed by Section 8 of the Act.</li>
<li aria-level="2">Mandatory Referral: Under Section 8 of the Act, once the conditions are satisfied, the judicial authority is mandated to refer the parties to arbitration. This court does not have any discretion in this matter.</li>
<li aria-level="2">No Waiver of Right to Arbitrate: The applicant has not waived its right to seek arbitration. It has not submitted any statement on the substance of the dispute before this court, or any other court.</li>
<li aria-level="2">The court's role is limited: The court's role is only to determine the existence and validity of the arbitration agreement at this stage. Issues of fraud, coercion, or other contractual disputes should be addressed by the arbitral tribunal.</li>
